Manufacturer-Specific California Lemon Law

Most California Lemon Law claims involve recurring pattern defects that cluster by manufacturer and platform. Knowing the pattern accelerates the claim: pattern defects are documented in manufacturer Technical Service Bulletins (TSBs), confirmed by NHTSA complaint counts, and often subject to recalls or class settlements. Two procedural facts also vary by manufacturer: arbitration participation (BBB Auto Line for Honda/Toyota/Hyundai/Kia/Nissan/Subaru; NCDS for Ford/Lincoln; no qualified arbitration for Tesla/BMW/Mercedes/Audi-VW/Stellantis/GM, meaning direct litigation), and the defense playbook each OEM uses. How Manufacturer Matters

  • Pattern defects identify the strongest claims. A defect that affects 50,000 vehicles is harder for the OEM to deny than a one-off.
  • Arbitration adds time. BBB Auto Line / NCDS participants take 6–8 weeks longer to reach litigation.
  • Each OEM has a defense playbook. “Could not duplicate,” “consumer abuse,” “de minimis impairment” — experienced counsel knows which the manufacturer will use.
  • Settlement appetite varies. Some OEMs settle pattern-defect claims quickly; others fight every case to discovery.
