- Each OEM has a defense playbook. “Could not duplicate,” “consumer abuse,” “de minimis impairment” — experienced counsel knows which the manufacturer will use.
- Settlement appetite varies. Some OEMs settle pattern-defect claims quickly; others fight every case to discovery.
